Joseph H. Baker, delegate elect from Boone, Logan, and Wyoming, appeared, was duly qualified and took his seat.
The following communication was received from the Senate.

The Senate this day passed the following bill in which they ask the concurrence of the House of Delegates.
Senate Bill No. 7, entitled "An Act to amend and re-enact the 2d and 3d Sections of the 3d Chapter of the Code of 1860," which was read the first and second times and referred to the Committee for Courts of Justice.
The Chairman of the committee of Finance reported that it was inexpedient to legislate on the resolution authorizing the Auditor of Public accounts to pay to Isaac Boker of Harrison County, out of any money in the Treasury, not otherwise appropriated, the sum of Forty-three dollars and fifty-nine cents, the amount of tax erroneously assessed against him for the years 1858, 1859 and 1860, on land lying in said county. Also, that it was inexpedient to legislate on the resolution in reference "to appropriating a bounty to those soldiers who first volunteered in the service of their country, who have received no county bounty."
The Chairman of the committee of Proposition and Gr[i]evances reported the following bill.
No. 27, A Bill declaring a part of the bank of Elk River in the county of Kanawha "a lawful fence," which on motion was read the first time.
The Chairman of the committee on Roads and Internal Navigation reported the following bills which was read the first time.
No. 28, "A Bill making an appropriation for repairing and finishing a part of the Buffalo and Leading Creek Turnpike Road in the county of Tucker."
No. 29, "A Bill making an appropriation out of the State tax of Morgan county for the year 1861 and 1862 for the repairs of the Morgan and Fredrick Turnpike Road."
Mr. Logan asked for and obtained permission to report the following bill, which was read the first time.
No. 30, "A Bill to incorporate Logan tribe No. 21 of the Improved Order of Red Men in the City of Wheeling."
Resolved, That the committee for Courts of Justice enquire into the expediency of reporting a bill authorizing the present Board of Public Works to revive suits brought by the former Board of Public Works, which have been abated by the change made in the said Board by the re-organization of the Board.
On motion of Mr. Logan,
Resolved, That the committee of Finance be instructed to enquire into the expediency of increasing the compensation allowed to Sheriffs for collection of the Revenue.
Mr. Vance asked and obtained leave to report the following bill, which on motion, was read the first time.
No. 31, "A Bill to incorporate the Clarksburg Coal and Iron Company."
No. 14, Engrossed House Bill, "An Act authorizing the county Court of Marshall county to re-assess Two hundred and six acres of land in Marshall county, belonging to Spencer Biddle, was taken up and the question being on the passage of the bill the vote was recorded as follows:

No. 15, Engrossed House Bill, "An Act authorizing the County Court of Ohio County to reassess nine acres of land belonging to Joseph Hidenger was taken up, and the question being on the passage of the Bill the vote was recorded as follows:
YEAS - Messrs. Porter (Speaker), Barker, Bumgarner, Davidson, Farnsworth, Fast, Hooton, Kramer, Keeney, Logan, Michael, Miner, Myers, Kitchen, Parsons, Patrick, Ratcliff, Rollyson, Ruffner, Swan, Wilson, West, Wheat, Williamson of Pleasants - 25.
NAYS - Messrs. Davis - 1.
No. 12, Engrossed House Bill, "An Act authorizing the Counties of Upshur and Preston to issue County Treasury notes for the purpose of paying the volunteers of said counties," was taken up, and thereupon Mr. Farnsworth moved to reconsider the vote ordering the bill to engrossment and the question being put it was determined in the affirmative whereupon he moved to amend in the second line by inserting in lieu of the words 'one dollar or less' the words 'not less than one dollar,' and the question being put it was determined in the affirmative; Mr. Farnsworth moved further to amend by inserting the following as an independent section, as the 7th section and any law to the contrary notwithstanding, and this act shall apply only to the County Courts of the counties of Upshur and Preston for the purposes of this act; and thereupon, Mr. Davis demanded the yeas and nays, which demand being sustained, the vote was recorded as follows:
YEAS - Messrs. Barker, Bumgarner, Farnsworth, Hooton, Kramer, Keeney, Michael, Miner, Kitchen, Rollyson, Ruffner, Smith, Swan, West, Wheat, Williamson of Pleasants, Zinn - 18.
NAYS - Messrs. Porter (Speaker), Boyer, Davidson, Davis, Logan Myers, Parsons, Patrick, Ratcliff, Vance, Wilson, Williamson of Wirt - 12.
Mr. Farnsworth moved to amend the 7th section as follows: "this act shall only apply to the counties of Upshur and Preston, and that no law shall prevent the provision of this act in said counties;" and thereupon Mr. Patrick demanded the yeas and nays, which demand was sustained, and thereupon motion of Mr. Farnsworth, the further consideration of the bill was passed by for the present.
On motion of Mr. Logan,
House Bill No. 3 on its second reading, heretofore laid on the table, was taken up, it being a bill to amend an act with its supplements entitled "An Act to incorporate the City of Wheeling in Ohio County" and thereupon, he offered a substitute for the bill, which being read the first time, was ordered to engrossment.
The Chairman of Special Committee on the Stay Law, presented a minority report entitled a bill providing for the amending and re-enacting of an act passed by the General Assembly on the 8th day of February, 1862, entitled "An Act staying the collection of certain debts," which was read the first time, laid on the table and ordered to be printed.
